Amendment to the GTC of smino 2023

At smino, we are always striving to improve our business practices in order to provide you, our valued customer, with a first-class service.
Updating our T&Cs was a necessary step to ensure that we comply with current legal requirements and continue to protect your interests in the best possible way.
The main changes to our T&Cs include:

• • More precise definition of the service offered to B2B customers only
  • Adaptation of the GTC with regard to German law for our German customers
  • More detailed description of our individual services and the modular purchase
  • Update of the “Rights and obligations of the provider”, specification that you as the customer are responsible for the creation of backus for your data
  • Agreement on the right to hire subcontractors for the provision and further development of the app
  • External use by third parties was excluded
  • Addition that late payment of the invoice may incur interest on arrears within the statutory framework (Germany = 9%, Switzerland = 5%)
  • The warranty is now described in much more detail in section 7
  • The liability provisions in section 8 have been extended to German law
  • How the contractual relationship can be terminated is now described in more detail in section 9
  • The “Ghosts” function was newly included in point 10, item 5
  • The automated reference citation has been newly introduced in section 11
  • Section 13, point 2 describes the new process for adapting the GTCs in the future
